By signing this waiver, I voluntarily agree to the following:

I, the undersigned passenger, understand and acknowledge that participating in a pontoon boat charter involves certain inherent risks, including but not limited to slipping, falling, drowning, collisions, changing weather conditions, water hazards, equipment malfunction, and the actions of other passengers or boaters.

1.  I understand that boating activities may be dangerous and I assume all risks associated with participating in this charter whether the activities are on board or off board the vessel.

2. I certify that I am physically able to participate in boating activities and will follow all safety instructions provided by the Captain.

3. I agree to wear a life jacket if instructed and comply with all boating safety rules and regulations.

4. I understand that alcohol consumption may increase the risk of injury and I accept full responsibility for my actions while onboard and agree to pay any fines that pertain to alcohol consumption issued by the ODNR or any other law enforcement agency.

5. I release and hold harmless the Boat Owner/Captain, their agents, employees, and representatives from any and all claims, liabilities, damages, injuries, losses, or expenses arising from participation in this charter, including those caused by negligence to the fullest extent permitted by law.

6. I agree that the Boat Owner/Captain has the right to refuse service or terminate the charter for unsafe, illegal, reckless, or disorderly behavior without refund.

7. I understand that I am responsible for any damages caused by my actions or negligence while onboard the vessel.

8. This waiver shall be binding upon me, my heirs, family members, executors, and assigns.

By signing below, I acknowledge that I have read, understood, and voluntarily agree to this Liability Waiver and Assumption of Risk Agreement.
